SCOPE OF APPLICATION
All capitalised words not defined herein shall have the same meaning as specified in the Terms and Conditions of BOLIDES (the “Terms and Conditions”).
As used in this privacy and cookie policy (the “Policy”), the terms “using” and “processing” of Personal Data (as defined below) include subjecting the personal information to statistical or other analysis and using or handling personal information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within the BOLIDES organisation or among our affiliates internationally.
The terms of this Policy will govern the use of the Application and contain important information on the collection and processing of Personal Data through the Application by BOLIDES. By using the Application and sharing your personal data, you explicitly acknowledge the manner in which BOLIDES collects and processes your Personal Data, including cookies, as described in this Policy. If you do not agree with any of the provisions of this Policy, please do not use our Application.
BOLIDES (“we” or “us”) provides this Policy to inform you of our policies and procedures regarding the collection, use and disclosure of Personal Data we receive from Users of the Application. This Policy applies to all Personal Data that is provided to us through the Application.
WHAT INFORMATION DO WE COLLECT?
BOLIDES collects and processes two types of information: (i) information Users provide to us and (ii) information relating to the User’s use of the Application (collectively the “Personal Data”). Personal Data shall have the meaning as ascribed to it in applicable Belgian and European law.
If you prefer to add or provide additional Personal Data to your personal settings, you provide BOLIDES with explicit approval to use this additional Personal Data in accordance with this Policy.
(i) Information you provide to us:
Account:
When you sign up to the Application and create an Account, fill out your public profile, book a vehicle, use a vehicle, send us an email or communicate with our customer service, you are voluntarily providing us with certain individually identifiable information that we collect and process. Such personal information may include but is not limited to your name, physical address, email address, telephone number, billing information, driving license ID, identity card ID, driving record, bank account or other payment details and other personal details like gender, age and other demographic information. By voluntarily giving us this personal information, you consent to such personal information being collected, used, disclosed, and stored by us, as described in our Terms and Conditions and this Policy.
We will collect additional information you may choose to provide to us on your Account, such as photos, descriptions of your interests, commuting habits, languages spoken, who you are, where you live and what you do for a living.
Additionally, we might collect necessary information from Users in order to complete all legally obligated paperwork in each country/region in which either the User or where BOLIDES is active.
Credit card details:
We will also ask for your credit card details if you complete the membership registration process. Credit card details will not be stored by BOLIDES and will be exclusively handled by our external secure payment provider.
Correspondence:
When you contact our customer service or anyone of the BOLIDES staff, we may keep a record of that correspondence and collect the necessary information to classify your question, respond to it and, if applicable, investigate any breach of our Terms and Conditions or this Policy. While we do not use this information for advertising, we may also use this information to identify and track potential problems and trends, and customise our Service to you.
(ii) Information we learn about you from your use of the Application:
We may collect or process certain non-personal information or aggregated data about how and when you use the Application. This information is usually of a technical nature (device settings and information, including but not limited to the type of browser, operating system, keyboard language, screen resolution, IP address, location, etc.) and behavioural nature (the actions taken by you on the Application, including but not limited to access times, pages requested, actions executed, etc.) and is used to compile statistical data about the Use of our Application.
We may also collect additional information in connection with your participation in any promotions offered by us and information you provide when giving us feedback.
Purposes of collecting information
BOLIDES only collects the Personal Data for the following purposes:
1/ We require certain Personal Data to allow us to process your Vehicle bookings on the Application and to allow you to use our Vehicles through the Application.
2/ Beyond the collection of your Personal Data to provide the Service as a mobility provider, we may collect and use your Personal Data to:
a. Improve user experience:
Tracking your use of the Application will allow us to personalise our Service to your needs and process uploaded data related to your profile such as vehicle reservation, vehicle use and payments. It will allow you to correctly use the Application. This will also allow us to learn more about User preferences and general trends on the Application in order to improve the quality of the Application and personalise your experience.
b. Provide customer service:
We will perform general customer administration of your Account by providing you with specific information and services available only to registered Users, sending you communications about the Application (e.g. upcoming changes or improvements) as well as our other products and services and respond to your questions, treat your requests or troubleshoot any problems.
c. Perform marketing actions:
Statistical or anonymous visitor information about our Users and the Use of our Application can be disclosed to third parties for marketing, advertising and promotional purposes. We generate anonymous statistics about the (use and Users of the) Application in order to improve the Application or convey statistical information to third parties. We can also contact you with tailored suggestions and information about events and other products or services.
You can choose to opt-out of marketing promotions from BOLIDES and/or third parties and/or mail/email correspondence from BOLIDES) if you do not want that your Personal Data is used for any of the aforementioned purposes. If you do not want to receive commercial communications from us, you can choose to unsubscribe from such commercial communications at any time.
d. Comply with legal and ethical requirements:
We may verify the compliance with your obligations set out in our Terms and our Policy and investigate fraud and infringements on all applicable rules and regulations.
We will ask for your consent before using any Personal Data for a purpose other than those that are set out in this Policy. As mentioned above, you can object at any time to the use of your Personal Data for direct marketing purposes free of charge.
By signing up for the Application, you acknowledge and accept that your Personal Data and any other information that you provide, including sensitive personal information, will be available in countries outside of Belgium. In this context, it is possible that the legislation of non-European countries guarantees less strict protection of your data.
Disclosure to third parties
a. To payment parties
BOLIDES transfers certain Personal Data, which includes information about your method of payment and trip, to the credit or debit card company that issued the credit card used for your trip. BOLIDES would like to make you aware that these sites may have different security and privacy policies and that we have no control over and take no responsibility for any information contained in these sites. BOLIDES will never share these Personal Data with other parties.
b. For legal purposes
We may also disclose or provide access to your Personal Data in order to comply with the law or in case of illegal use, when we receive orders from legal authorities, to enforce our Terms and Conditions and other policies, and to protect the rights, property and safety of our Users, us or others.
c. To trusted third parties
Third parties can access all information intended to be made public by you on your Profile. Such information may contain Personal Information. We do not sell, trade, or otherwise transfer your Personal Data to any third party, unless you give your explicit permission. This does not include trusted third parties who assist us in operating the Application, conducting our business or servicing you, so long as those parties agree to keep this information confidential and to process such information solely in accordance with the purposes set forth herein.
d. Third Party Websites
While using the Application you may encounter links to third party websites. Please note that such third-party websites are not related to the Application, and we assume no responsibility or liability whatsoever with regard to privacy matters or any other legal matter with respect to such third-party websites. We encourage you to carefully read the privacy policies and the terms and conditions of such websites.
e. To group companies
BOLIDES may disclose and transfer all information collected to its holding company (Bolides NV), any company that is a subsidiary of BOLIDES or the BOLIDES’s holding companies, or any company that has a joint venture with BOLIDES or the BOLIDES’s holding companies.
f. Lawfulness of processing
The processing of Personal Data by BOLIDES shall be lawful as you expressly consented to the processing of Personal Data for the purposes set out in this Policy. You shall at all times have the right to withdraw your consent at any time, however, such withdrawal shall in no event affect the lawfulness of the processing of the Personal Data (i) prior to such withdrawal, (ii) that is necessary for the performance of the Terms and Conditions (including the functioning of the Application) or (ii) based on any other lawful reason to process Personal Data.
You acknowledge and agree that providing and processing of Personal Data is necessary for the performance of the Terms and Conditions (including the functioning of the Application) pursuant to which you are entitled access and use the Application. In the event you refuse to provide Personal Data, BOLIDES may not be able to perform its obligations under the Terms and Conditions and you might not be able nor entitled to access and use the Application.
The foregoing reasons are in no event exhaustive and BOLIDES shall at all times be entitled to process your Personal Data for any other lawful reason. In such event, BOLIDES shall notify you as soon as possible for any such reason. An update of this Policy in accordance with article 9 of this Policy might be considered a notification.
Security of your Personal Data
In order to prevent the loss, misuse and alteration of your Personal Data on the Application, BOLIDES has implemented a variety of appropriate technical and organisational security measures conform with or exceeding industry standard technologies, in order to safeguard the confidentiality of your Personal Data and ensure your online safety. However, BOLIDES cannot guarantee that unauthorised access will never occur.
BOLIDES uses its best efforts to protect the confidentiality and security of your Personal Data.
BOLIDES shall in no event be liable for any direct or indirect damages that result from a wrong or illegal handling.
You may not disclose to or share with any third parties your login details. Keeping your login details confidential and safe is your sole responsibility. If your password has been revealed or stolen, immediately inform us and report any privacy breach or abuse of login data by sending us an email at privacy@bolides.be.
Data retention period
We do not process your Personal Data any longer than is necessary for the purposes set forth in this Policy. However, we do store your Personal Data as long as your Account is active or when the processing of your Personal Data is necessary to allow you to make use of our Application.
Access to and modification or deletion of your Personal Data is free of charge. You may review, update, modify or delete your Personal Data at any time. Please promptly update your Personal Data if it changes. If you wish to delete your Account, you can send us an email at privacy@bolides.be and we will process your request according to our Terms and Conditions. Personal Data added by you will be stored for six (6) months after you delete such Personal Data or delete your entire Account.
We shall store the Personal Data as much as possible within the European Union, however, you expressly acknowledge and agree that your Personal Data may be stored in a country outside the European Union which legislation might guarantee less strict protection of your Personal Data.
Your rights
If and to the extent provided under applicable Belgian and European law, you shall have the right:
a) to obtain from BOLIDES confirmation as to whether or not your Personal Data are being processed and, where that is the case, you shall have the right to access such Personal Data being processed;
b) to obtain from BOLIDES, without undue delay, the rectification of inaccurate Personal Data and to have incomplete Personal Data completed;
c) to obtain from BOLIDES the erasure of Personal Data;
d) to obtain from BOLIDES the restriction of processing your Personal Data;
e) to receive the Personal Data in a structured and commonly used, machine-readable format and have such Personal Data transmitted;
f) to object to processing of your Personal Data and to object at any time to the processing of your Personal Data for direct marketing purposes.
In many cases you can improve or modify your Personal Data yourself in your personal settings. These rights can be exercised by sending an email to “privacy@bolides.be” or sending a letter to BOLIDES NV, Mechelsesteenweg 271 2018 Antwerpen, Belgium.
If and to the extent provided under applicable Belgian and European law, you shall have the right to lodge a complaint with the authorised supervisory authority if the processing of your Personal Data infringes applicable law.
Modifications to this Policy
We reserve the right to modify this Policy at any time. Any changes to the Policy will be published on the Application and will be brought to your attention for your approval. In case of significant changes to the Policy that results in BOLIDES using your Personal Data in a manner materially different from that stated at the time of the collection, we will provide you with a notice on the Application and/or send you an email notification. Changes to this Policy are effective as of the stated date of last revision. By continuing to use the Application after the latest update date, you explicitly state that you have read, understand, accept and agree to the changes in the Policy. If you don’t agree with the changes to the Policy, you may not further use the Application.
Approval for release
You recognize, confirm and explicitly give permission to BOLIDES to disclose your Personal Data if BOLIDES is required by law to do so or if BOLIDES has a good-faith belief that such action is necessary:
- a) to comply with a current judicial proceeding, a court order or a legal process regarding the Application;
b) to enforce the Terms and Conditions;
c) to reply to claims against BOLIDES in response to your Personal Data that violates the rights of third parties;
d) to safeguard the rights, property and safety of BOLIDES, its employees, its users and the public.
BOLIDES can disclose your Personal Data to police or judicial authorities or other official authorities if BOLIDES at its sole discretion believes this disclosure is necessary or useful regarding a fraud investigation, intellectual property infringements or any other malicious activity or if BOLIDES reasonably suspects such operation can expose BOLIDES or yourself to liability. - Cookies
BOLIDES uses cookies. Cookies are small pieces of information that are stored by your browser on your computer’s or mobile device’s hard drive. These cookies allow the Application to remember information that changes the way the Application behaves or looks, such as your preferred language. Furthermore, the Application uses cookies in order to determine the circle of users and to ease the use of and navigation on the Application. E.g. cookies are used to prevent you from having to log in every time for personalised services by entering your user name and password. The use of cookies is generally accepted and virtually all important Applications use them.
Following cookies are being stored when you visit and use BOLIDES’s Application:
– You can configure your internet browser in order to be informed of each cookie sent or systematically refuse them by modifying the parameters of your browser. BOLIDES cannot guarantee the access, use and operation of the Application if the storage of cookies is disabled by your internet browser.
The Use of Google Maps
This page, as well as the BOLIDES application, use Google Maps API applications. Said applications are essential for BOLIDES’s services to be able to operate and for them to be provided in full. You can find Google’s Terms and Conditions of Use here. You can find Google’s Privacy Policy (data protection provisions) here. The use of Google Maps helps BOLIDES to ascertain the current location of the vehicles at any given time and to show the Users where the nearest available vehicle is. In addition it is used to record the destination, the start and finish times and the duration of the use. This information is not passed on to Google; all location data transferred to Google is transferred in anonymous form.
Legislation and competent courts
This Policy is governed by and construed in accordance with the Belgian legislation that is exclusively applicable to any potential dispute.
Any dispute arising under, or in connection with, this Policy shall be settled exclusively by the competent courts of Antwerp, Belgium.
Translation
The original version of the Policy is drafted in English. When the Policy is being translated into another language, the English version shall prevail. Translated Policies will be interpreted on the basis of the original English version.
